Take Note - FLSA Updates
The U.S. Department of Labor has issued a final rule under the Fair Labor
Standards Act (FLSA) to aid employers and workers in determining whether a
worker is an employee or an independent contractor. Because misclassification
can deny workers their rights, the "Employee or Independent Contractor Classification"
under the (FLSA) aims to protect workers from misclassification, ensuring a consistent
approach for businesses engaging with independent contractors. The rule restores a
multifactor analysis, considers all factors without assigning predetermined weights,
and aligns with economic reality factors. It also rescinds the 2021 Independent Contractor
Rule to help reduce confusion and improve compliance while protecting workers and ensuring
fair competition among employers. For more detailed information visit
